A former Belvedere resident charged with killing his son in a boating mishap has completed his diversion program, and a judge dismissed his case Thursday.

The defense sought from the outset to reduce the case from a felony matter. It alleged the boy’s death was caused by boat design defects that failed to protect him from the propeller. It also argued that the evidence of legal intoxication was inconclusive, and that Burillo did everything he could to save his son.
Judge Beverly Wood agreed to reduce the charges to misdemeanors.
Later, Judge Geoffrey Howard granted diversion in the case, allowing Burillo to potentially avoid a conviction and get a clean slate if he completed certain rehabilitative requirements.
The Marin County District Attorney’s Office opposed diversion.
“This office strongly believes in rehabilitation, but Mr. Burillo’s case resulted in the death of a child which we believe requires a higher level of accountability than diversion,” District Attorney Lori Frugoli said at the time.
Burillo, a resort developer whose family owns the Mexican media conglomerate Televisa, sold his home in on Bellevue Avenue in Belvedere after the incident.
“Mr.
Burillo is very grateful for this dismissal, and thanks the Marin courts for treating this very difficult case fairly and compassionately,” his defense attorney, Douglas Horngrad, said Thursday. “Since this tragedy, Javier has dedicated himself to his rehabilitation and sobriety.”
“Most importantly, Javier now works full time for his charity named for his son, Grant’s Crusade, which is dedicated to helping neurodiverse children in need of support, and assistance, everywhere,” Horngrad said.
